Rent Freeze Litigation Tests Limits of Mayoral Influence Over Housing Policy
A New York state judge questioned whether landlords can prove Mayor Zohran Mamdani improperly influenced the city’s Rent Guidelines Board to approve a rent freeze on stabilized apartments. Landlords, represented by attorney Randy Mastro, argue the board—packed with Mamdani appointees—cherry-picked data to deliver the mayor’s campaign promise rather than independently weighing tenant affordability against landlord costs. Justice Brendan Lantry pressed Mastro to substantiate claims that the board ignored landlords’ debt payments and was “spoon-fed” a presentation on the true cost of living by the mayor’s office. Lantry noted that mayors are legally permitted to appoint board members and that the city’s housing agency can communicate with the board.
Mastro conceded that landlords’ net operating income increased under the board’s calculation but disputed the methodology, arguing it artificially deflates costs by including revenue from market-rate units in mixed buildings. City lawyers pointed to months of public records showing the board considered extensive data and testimony before voting. “It’s a vote. It is not a mathematical equation or formula,” said city attorney Rachel Moston. Lantry said he would issue a decision quickly, with the rent freeze scheduled to take effect in October.
Litigation has become the primary tool for opponents of Mamdani’s housing agenda nine months into his first term. Mastro, a former deputy mayor under Eric Adams, is also suing the administration over the rollout of a luxury second-home tax. Many Mamdani critics, caught off guard by his election, now have few avenues beyond the courts to challenge his policies. The rent-freeze lawsuit was initially filed in Staten Island, the only borough Mamdani lost in November, before a judge moved it to Manhattan.
